General Terms and Conditions for the online shop druff.shop

This English version is provided for your information. The German version is legally binding.

1. Provider and scope

1.1 The online shop at druff.shop is operated by Selwie GmbH, Aachstrasse 2, 9326 Horn, Switzerland, UID CHE-109.476.355, email: info@selwie.com ("we" or "us").

1.2 These terms govern all orders placed with us by customers ("you") via our online shop or by other means of distance communication (e.g. email). The version in force at the time of the order applies.

1.3 You may order from us as a consumer or as a business. A consumer is anyone who orders for purposes that are predominantly outside their trade, business or profession. A business is anyone acting in the exercise of their trade, business or profession when placing the order. Where these terms differ for consumers and businesses, this is expressly stated.

1.4 General terms and conditions of businesses only become part of the contract if we expressly agree to them.

2. Ordering and conclusion of the contract

2.1 The products in our online shop are an invitation to place an order and do not constitute a binding offer on our part.

2.2 How to order: add the desired items to your cart and go to checkout. Enter your contact and delivery details and choose shipping and payment methods. Before submitting, you see an overview of your order and can check and correct all details. By clicking the order button (e.g. "Pay now") you make a binding offer to purchase the items in your cart.

2.3 Shortly after your order you will receive an automatic email confirming receipt of your order and listing its details.

2.4 The contract is concluded when we accept your offer, by a separate order or shipping confirmation by email or by dispatching the goods, whichever occurs first. If you choose a payment method where payment is triggered when ordering (e.g. PayPal, credit card, Apple Pay, Google Pay or Shop Pay), we accept your offer upon completion of that payment.

2.5 We store the contract text. You receive the order details with the confirmation email; these terms can be accessed and printed on our website at any time. If you have created a customer account, you will also find your orders there.

2.6 The contract is concluded in German.

3. Prices and shipping costs

3.1 Our prices are final prices and include statutory VAT unless stated otherwise for the product.

3.2 Shipping costs are added as listed on our "Shipping & delivery" page and shown to you before you submit your order.

3.3 For deliveries into Switzerland or from Switzerland into the EU, import charges such as customs duties or import VAT and customs clearance fees may apply. These are not included in our prices and are usually collected by the carrier on delivery. The same applies to fees charged by your bank, e.g. for foreign payments or currency conversion.

4. Payment

4.1 The available payment methods are shown at checkout. Depending on the delivery country they include credit card, PayPal, Klarna, Apple Pay, Google Pay and Shop Pay.

4.2 Payment is processed by the respective payment service provider, e.g. Shopify Payments, PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg, or Klarna Bank AB (publ), Stockholm, Sweden. Their terms of use also apply.

4.3 The purchase price is due upon conclusion of the contract unless a later payment date applies to the chosen payment method (e.g. pay later with Klarna).

5. Delivery

5.1 We deliver to the delivery address you provide in the countries selectable at checkout, usually with DHL.

5.2 The expected delivery time is stated with the product or on our "Shipping & delivery" page. As soon as your parcel is on its way, you receive a shipping confirmation with tracking.

5.3 If an ordered item cannot be delivered because we do not receive it ourselves despite timely ordering, we will inform you without delay and refund any payments already made.

5.4 If the goods cannot be delivered for a reason you are responsible for (e.g. wrong address), we may charge the reasonable costs incurred. This does not apply to the outbound shipping costs if you validly exercise your right of withdrawal.

5.5 If you are a consumer, we bear the risk of loss of or damage to the goods in transit until they are handed over to you. If you are a business, this risk passes to you once we hand the goods to the carrier.

6. Subscriptions

6.1 Selected products can also be ordered as a subscription. You then receive the goods at the interval stated for the product (e.g. monthly) at the subscription price stated there. Each delivery is charged to the payment method chosen when ordering.

6.2 You can cancel your subscription at any time without notice or postpone the next delivery, via the links in your order emails, in your customer account or by email to info@selwie.com. Cancellation applies to all deliveries not yet dispatched when it is received.

6.3 Your statutory right of withdrawal remains unaffected.

7. Retention of title

The goods remain our property until paid in full.

8. Rights in case of defects

8.1 If the goods delivered are defective, you have the statutory rights unless otherwise provided below. If you are a consumer, your claims for defects in new goods become time-barred no earlier than two years after delivery; further mandatory rights under the law of your country of residence remain unaffected.

8.2 If you are a business, the following applies: we decide whether to remedy the defect by repair or replacement. Claims for defects in new goods become time-barred one year after delivery. You must inspect the goods promptly upon receipt and notify defects without delay (Art. 201 Swiss Code of Obligations); hidden defects must be notified immediately upon discovery. Statutory recourse claims remain unaffected.

8.3 The deviations in clause 8.2 do not apply to claims for damages or reimbursement of futile expenses, nor if we have fraudulently concealed a defect.

8.4 If a delivery arrives visibly damaged, we would appreciate it if you report the damage to the carrier and let us know by email. Your rights in case of defects do not depend on this.

9. Liability

9.1 We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, for claims under a guarantee we have given, under product liability law and other mandatory statutory provisions.

9.2 If we slightly negligently breach an obligation whose fulfilment is essential for the proper performance of the contract and on which you may regularly rely (essential contractual obligation), our liability is limited to the foreseeable damage typical for the contract. We are not liable for slightly negligent breaches of other obligations.

9.3 These rules also apply to our legal representatives and vicarious agents.

10. Right of withdrawal

As a consumer you have a right of withdrawal. Details can be found in our withdrawal policy.

11. Applicable law and place of jurisdiction

11.1 Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident in another country (e.g. Germany or Austria), you retain the protection of the mandatory consumer protection provisions of that country.

11.2 If you order as a business, the exclusive place of jurisdiction for all disputes arising from the contract is Horn TG (Switzerland). We may also sue at your registered office. For consumers, the statutory places of jurisdiction apply; consumers may in particular sue and be sued at their place of residence.

12. Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. If you have questions or problems, simply write to info@selwie.com and we will find a solution together.

13. Final provisions

Should any provision of these terms be invalid, the remaining provisions remain valid. The invalid provision is replaced by the statutory provisions.
